TERMS AND CONDITIONS OF BUSINESS

1. GENERAL

These Terms and Conditions apply to all quotations, estimates and works carried out by Lee Marshall Electrical (“the Contractor”) for the customer (“the Client”).

Acceptance of any quotation, estimate, email confirmation, purchase order, electronic acceptance, or instruction to commence work shall constitute acceptance of these Terms and Conditions.

2. QUOTATIONS

2.1 All quotations are valid for 30 days unless otherwise stated.

2.2 Quotations are based on a visual inspection where applicable and on the information provided by the Client.

2.3 Quotations do not include any work not specifically stated within the quotation.

2.4 Quotations may be withdrawn or amended prior to acceptance.

3. VARIATIONS AND ADDITIONAL WORKS

3.1 Any additional work requested by the Client that falls outside the original quotation shall be treated as a variation.

3.2 Variations will be charged at the Contractor’s current labour and material rates unless otherwise agreed.

3.3 The Contractor will endeavour to notify the Client of additional costs before proceeding.

4. HIDDEN DEFECTS AND UNFORESEEN CONDITIONS

4.1 Electrical installations are often concealed within walls, floors, ceilings and other building structures.

4.2 The Contractor cannot reasonably identify all defects, faults or non-compliances prior to commencing work.

4.3 If hidden defects, damaged wiring, unsafe installations, inadequate earthing or bonding, obsolete equipment,

previous poor workmanship, or any other unforeseen condition is discovered during the works, the Contractor

shall notify the Client as soon as reasonably practicable.

4.4 Any remedial work required as a result of such discoveries shall be chargeable in addition to the original quotation.

4.5 The Contractor reserves the right to suspend work where continuing would compromise safety or breach current regulations.

5. ACCESS

5.1 The Client shall provide safe and reasonable access to the property and work areas.

5.2 Delays caused by restricted access, unavailable occupants, third-party contractors or site conditions may result in additional charges.

6. CLIENT RESPONSIBILITIES

6.1 The Client shall remove or adequately protect valuable items, furniture and possessions in the vicinity of the works.

6.2 The Contractor shall not be responsible for damage to items that could not reasonably be avoided during normal installation activities.

7. PAYMENT TERMS

7.1 Unless otherwise agreed in writing, payment is due within 7 days of invoice.

7.2 Larger projects may require stage payments or deposits.

7.3 Materials specifically ordered for a project may require payment in advance.

7.4 The Contractor reserves the right to suspend works where agreed payments are not received.

7.5 Ownership of all materials supplied shall remain with the Contractor until full payment has been received.

8. LATE PAYMENT

8.1 The Contractor reserves the right to charge interest on overdue accounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 where applicable.

8.2 The Client shall be responsible for any reasonable costs incurred in recovering outstanding debts.

9. CERTIFICATION

9.1 Electrical certificates, inspection reports and Building Regulations notifications (where applicable) will be issued following completion of the works and receipt of full payment.

9.2 Certification will only cover the work undertaken by the Contractor unless specifically stated otherwise.

10. COMPLIANCE

10.1 All work shall be carried out in accordance with the current edition of BS7671 Requirements for Electrical Installations and other relevant legislation applicable at the time of installation.

10.2 The Contractor reserves the right to refuse requests that would result in non-compliant or unsafe work.

11. DAMAGE AND MAKING GOOD

11.1 Whilst every care will be taken, minor damage may occur when accessing concealed wiring or equipment.

11.2 Unless specifically included within the quotation, making good, plastering, decorating, tiling, flooring repairs and similar remedial works are excluded.

11.3 The Contractor shall not be responsible for cosmetic differences resulting from replacement accessories or equipment where exact matches are unavailable.

12. GUARANTEE

12.1 Labour provided by the Contractor is guaranteed for a period of 12 months from completion.

12.2 Manufacturer warranties apply to materials and equipment supplied.

12.3 The guarantee shall not apply where defects arise from misuse, neglect, third-party alterations, external factors, normal wear and tear, or existing defects outside the Contractor’s scope of work.

13. CANCELLATION

13.1 The Client may cancel the works by providing written notice.

13.2 The Client shall remain liable for work completed, materials purchased and any non-refundable costs incurred.

13.3 Special-order materials cannot normally be returned and shall be chargeable in full.

14. HEALTH AND SAFETY

14.1 The Contractor reserves the right to cease work immediately where unsafe conditions exist.

14.2 Any time lost due to unsafe conditions may be chargeable.

15. LIMITATION OF LIABILITY

15.1 The Contractor’s liability for any claim arising from the works shall be limited to the value of the contract.

15.2 The Contractor shall not be liable for indirect, consequential or financial losses including loss of income, business interruption or inconvenience.

16. FORCE MAJEURE

The Contractor shall not be liable for delays caused by circumstances beyond reasonable control including severe weather, material shortages, supplier delays, accidents, illness, industrial disputes or acts of God.

17. GOVERNING LAW

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

Lee Marshall Electrical reserves the right to amend these Terms and Conditions at any time. The version attached to the accepted quotation shall apply to the contract.
